In this edition of Tarikh, Nikhil talks about Criminal Tribes Act. Passed in 1871 by the British government, this act targeted entire communities and designated them as habitual criminals. Under these acts, ethnic or social communities were defined as “addicted to the systematic commission of non-bailable offences”.
Who communities were registered and declared ‘habitually criminal. Restriction on movement of these people was imposed and children were taken away from their parents. Transgender community was also severely affected by the act. After independence in 1949, Criminal Tribes Act was scrapped and the nomadic tribes were denotified. But a new law was introduced namely, habitual offenders act which continued the discrimination against the tribal community. Society and administration have since then internalised prejudice against these tribes and they still suffer after almost 150 years of the original act. Watch complete video to know more
