In this edition of Tarikh, Nikhil talks about Dr Anand Mohan Chakrabarty who received the world’s first patent of genetically modified living organism. He is famous for Diamond v. Chakrabarty, a landmark case in U.S. patent law that dealt with the issue of whether a living organism could be patented. In 1980, Ananda Mohan Chakrabarty, a microbiologist, filed a patent application for a genetically engineered bacterium that could break down crude oil.
The U.S. Patent and Trademark Office (USPTO) rejected Chakrabarty’s application, arguing that living organisms were not patentable subject matter under the relevant patent law. Chakrabarty appealed the decision, and the case ultimately reached the United States Supreme Court.
The Court’s decision in Diamond v. Chakrabarty has had significant implications for the biotechnology industry, as it established that genetically modified organisms can be patented. It also set a precedent for the patentability of other types of living organisms, such as plants and animals, that have been modified through human intervention.
