In this edition of Tarikh, Nikhil talks about the Shah Bano case and The Muslim Women (Protection of Rights on Divorce) Act 1986. The case Started when one Muslim woman submitted a petition in Court for alimony against his husband Muhammad Ali khan. The Supreme Court in this case decided that women’s right to alimony under CrPC is above the Muslim personal law/ Additionally the supreme court in its decision remarked the need for reforms in Muslim personal law that led to a political battle as well as a controversy about the extent to which courts can interfere in Muslim personal law. The case laid the ground for Muslim women’s fight for equal rights in matters of marriage and divorce in regular courts, the most recent example being the Shayara Bano case in which the Supreme Court invalidated the practice of instant triple talaq.
