The Supreme Court has raised sharp concerns over Ladakh climate activist Sonam Wangchuk’s health and prolonged custody under the National Security Act (NSA), asking the Centre whether it can “rethink” his preventive detention five months after a September 26, 2025 order and amid medical reports that his condition is “not good.” Hearing a habeas corpus plea filed by his wife, Dr Gitanjali Angmo, a bench of Justices Aravind Kumar and PB Varale pressed Additional Solicitor General KM Nataraj to look beyond legal technicalities, even as the government opposed any relief and blamed Wangchuk’s alleged “provocative” speeches for the September 24 Leh violence that left four dead and over 150 injured, citing his references to Arab Spring, Gen Z uprisings, and “us vs them” language about the Centre as grounds for NSA. The Court, however, questioned whether simply perceiving a “potential threat” or copy‑pasting a police recommendation is enough to justify detention, noting that if the original NSA order suffers from non‑application of mind, it can be struck down even if subsequent approval and Advisory Board confirmations weren’t separately challenged, turning this case into a test of how far “preventive” laws can go in branding a demand for Ladakh statehood and Sixth Schedule status as a national security threat rather than protected democratic dissent, Watch the Full Video Now!
