The Supreme Court of India has refused to entertain a petition seeking the registration of an FIR against Assam Chief Minister Himanta Biswa Sarma for alleged hate speech. The bench, led by the Chief Justice of India, dismissed the plea, directing the petitioners to approach the High Court first. The court observed a ‘disturbing trend’ of petitions being filed for publicity just before elections, stating that the apex court should not be turned into a political battleground. While the petitioners argued that the Assam police would not act against the sitting Chief Minister, the Supreme Court emphasized following the constitutionally prescribed route under Article 226. The court has requested the Chief Justice of the Gauhati High Court to provide an expeditious hearing if the matter is filed there. The allegations pertain to controversial remarks regarding the ‘Miya’ community and a viral video. The court reiterated that all parties must exercise self-restraint and uphold constitutional morality during election cycles.
