एससी एसटी एक्ट के कुछ प्रावधानों को चुनौती देने वाली याचिका पर सुप्रीम कोर्ट ने सुनवाई से इंकार कर दिया है। यशकर्ता का कहना था कि इस कानून का लगातार दुरुपयोग हो रहा है। समाज के एक बड़े तबके का यह कानून उत्पीड़न का जरिया बन गया है। लेकिन सुप्रीम कोर्ट ने कहा कि इस कानून में आरोपी को पहले से ही उत्पीड़न से बचाने के लिए पर्याप्त सुरक्षा उपाय मौजूद हैं। और अभी जो इस कानून की मौजूदा स्वरूप है उसे खुद सुप्रीम कोर्ट 2020 में सही ठहरा चुका है। लिहाजा 6 साल बाद इस फैसले पर फिर से विचार करने का कोई उचित बनता नहीं है। सुप्रीम कोर्ट में याचिका बृजभूषण सैनी की तरफ से दायर की गई थी।
The Supreme Court has refused to hear a petition challenging certain provisions of the SC/ST Act. The petitioner had argued that the law is being consistently misused and has become an instrument of harassment for a large section of society. However, the Supreme Court observed that the Act already contains adequate safeguards to protect the accused from harassment. Furthermore, the Court noted that it had upheld the current form of the law in 2020; therefore, there is no valid ground to reconsider that decision after six years. The petition was filed by Brijbhushan Saini.
